When the application was originally filed, the applicant was incorrectly identified as Homedics, Inc., a Michigan corporation. However, the
applicant should have been identified as FKA DISTRIBUTING, INC., a Michigan Corporation, doing business as Homedics, Inc. Homedics, Inc. did not exist as a lawful corporation in the state of Michigan
when the application was filed. In accordance with TMEP 1201.02(c)(1) - "If the applicant identifies itself by a name under which it does business, which is not a legal entity, then amendment to
state the applicant's correct legal name is permitted". In this case, the applicant did business at the time under the name Homedics, Inc. The applicant, now registrant, is the same entity today that
it was when the application was filed. The name was incorrectly given at the time the application was filed. Accordingly, the applicant/registrant makes this amendment to correct its name in the
Trademark Office records. |
