On behalf of Orange Brand Services Limited ("Registrant"), please consider this response to the Examining Attorney's Office Action dated February 28, 2020.

REMARKS

            The Examining Attorney acknowledged that the Registrant provided acceptable proof of use for the following goods in response to an audit inquiry:

• peripheral equipment for computers
• apparatus and installations and the operation and management of a telecommunications network
• telecommunications apparatus, namely, modems, to enable connection to databases and the global computer network
• modems
• electronic monitoring equipment and instruments for use in relation to telephony networks, telemetry, signaling and system capabilities for use in tracking telecommunications and electronic signals and for monitoring electronic traffic across telecommunications lines, telemetry, signaling and system capabilities
• electrical and electronic instruments for use in controlling, testing, signaling and checking telecommunications and electronic signals for controlling, testing, signaling and checking the movement of electric and electronic traffic across telecommunications lines, telemetry, signaling and system capabilities

 

The Examining Attorney has now requested additional examples of use for the ORANGE & Device mark (“Mark”) in connection with other goods in Class 9.  Specifically, the Examining Attorney requested proof of use in commerce for the following goods:

• computers [online point-of-sale screen shot]
• computer programs and computer software all being for use in relation to the operation and management of telecommunications equipment [download screen]
• computer software supplied that may be downloaded from the Internet, being for use in relation to the operation and management of a telecommunications network service [download screen]
• computer software to enable searching of data [download screen]
• satellite transmitters and receivers [brochures; Terms of Service Agreement for satellites]
• electric wires and cables [online point-of-sale screen shot]
• telephones, mobile telephones and telephone handsets [online point-of-sale screen shot/photo of goods]
• computer keyboards, telephone keypads [online point-of-sale screen shot/photo of goods]
• electronic satellite global positioning systems [brochures; Terms of Service Agreement for satellites]
• electronic satellite navigational and positioning apparatus and instruments [brochures; Terms of Service Agreement for satellites]
• optical and electro-optical apparatus and instruments, namely, telephone display screens, video screens, video screens for use within a video phone, video cameras, video cameras for use in a video phone, computer display screens, backlighting units for display screens and liquid crystal display screens [online point-of-sale screen shots/photos of goods]

The Registrant attaches to this response proof of use of the Mark for these goods.  The nature of each example of use is noted above in brackets.  The title of each attached example of use references the corresponding goods.  In the case of satellite equipment, the Registrant provides examples of use in commerce appropriate for the goods in the ordinary course of trade for such goods.  Satellite equipment is not shipped and sold in typical retail channels and affixing the marks on the goods is impracticable. See T.M.E.P. § 904.03(k).  For satellite equipment, the Registrant has submitted brochures that picture the goods and feature the mark and a copy of documentation presented to a potential user explaining that the Registrant provides satellite equipment associated with the Mark.

The Examining Attorney also asked for a supporting declaration to verify the proof of use being submitted with this response.  A signed Declaration is provided with this response.

The Registrant has addressed all of the issues raised by the Examining Attorney and respectfully

 requests that the Examining Attorney accept the Section 8 Declaration.
