Receipt is acknowledged of the Affidavit submitted under the provisions of Sections 8 & 15 of the Trademark Act.
It is noted that a document was filed for recording in the Assignment Branch of the Patent and Trademark Office. Counsel is requested to inform the undersigned of the reel and frame numbers when the recorded document is returned. It is also noted that a copy of the document has been placed in the registration file which establishes ownership. If the Registrant decides not to wait for the Assignment Branch to record the document the Section 8 Notice of Acceptance may be issued provided that all other outstanding issues are resolved.
However, the Registrant should note that pursuant to Trademark Rule 3.85, the office records will continue to reflect the original registrant or the last recorded assignee as recorded in the Assignment Branch. The Section 8 Notice of Acceptance will not issue in the name of the new owner unless and until the transfer is recorded in the Assignment Branch.
All issues raised in this Office Action may be resolved by telephone. Therefore, a telephone call to the undersigned paralegal is recommended to expedite processing of the Section 8 Affidavit.
