In response to the Trademark Specialist's statement that there appears to be a break in the chain of title since the records do not show a transfer from "Merial Limited (An England Limited Company)" to "Merial Limited (A United Kingdom Limited Liability Company)", Registrant advises that there is no break in the chain of title because the descriptions identify the same company. The assignment and later filed change of name document both identify Merial Limited as a company "registered in England and Wales". However, the Trademark Assignment abstract of title shows no country of citizenship for Merial Limited in connection with the recorded assignment and change of name. The use of "United Kingdom limited liability company" to describe a limited liability company that is "registered in England and Wales" is completely accurate and is an accommodation to the fact that the Trademark Office will accept only one country of citizenship. Neither "England" nor "Wales" is a separate country. Both England and Wales are parts of the United Kingdom. Merial Limited is therefore accurately described both as a company that is registered in "England and Wales" and as a company organized the laws of the United Kingdom. If there are any questions concerning the foregoing, it would be appreciated if the Trademark Specialist would call the undersigned. |
