The Voluntary Amendment submitted on February 1, 2017 is refused for the following reasons:

The request was improperly submitted using an incorrect form.  Once the application has registered, a Voluntary Amendment form is used only to supplement or modify information already submitted through a Post-Registration filing prior to the Post-Registration Specialist examining the filing. WARNING: If you have not already made a Post-Registration filing, such as a Section 8, and you are merely trying to amend or correct a registration certificate, do NOT use the Preliminary/Voluntary Amendment form.

Furthermore, the Voluntary Amendment lacks sufficient information to determine the nature of the request and/or failed to meet statutory requirements under Section 7.   See TMEP 1609.

To submit a proper request under Section 7 please visit http://www.gov.uspto.report/trademarks/teas/reg_maintain.jsp and select Option No. 5 - Section 7 Request for Amendment or Correction of Registration Certificate.

A Form Section 7 Request to Amend the Registration should be submitted and must meet the following requirements, to name a few:

• Ownership of the subject registration must be identified. 15 U.S.C. §1057; 37 C.F.R. §3.73; TMEP §502.01;
• A Good Faith Statement explaining how the error occurred, if the mistake occurred through the fault of the registrant.
• Explanation of Filing is encouraged
• Submission of the Required Filing Fee of $100, if applicable. 15 U.S.C. §1057(e); 37 C.F.R. §§2.6 and 2.173(b)(1); TMEP §1609.10(b);
• Requests must be supported by a Declaration under 37 C.F.R. §2.20, properly signed and dated.
