DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by Tamar Niv Bessinger on August 22, 2017, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

IDENTIFICATION OF GOODS

 

The identification of goods is amended to read as follows:

 

“Milk and dairy products excluding ice cream, ice milk and frozen yogurt; dairy-based beverages,” in International Class 029;

 

“Dessert puddings; ice cream; ice cream products, namely, ice milk and frozen yogurt, ice cream cakes, ice cream desserts, frozen confectionery, ice cream drinks; chilled dairy-based desserts, namely dairy-based cakes, cookies, pastries, candies, dessert mousses, and dessert puddings; chilled dairy substitute-based desserts, namely soy-based ice cream substitute, non-dairy frozen confections, soy-based dessert mousses, and soy-based dessert puddings; chilled fruit-based desserts, namely sorbet, and dessert puddings containing fruits; chilled chocolate-based desserts, namely chocolate cakes, cookies, pastries, candies, mousses, and dessert puddings,” in International Class 030; and

 

 “Non-alcoholic beverages, namely, chocolate flavored soft drinks; preparations for making beverages, namely, chocolate flavored soft drinks,” in International Class 032.

DESCRIPTION OF MARK REQUIRED

 

The following description of the mark replaces the current description of record:

 

            The mark consists of the stylized word “YOLO” in gold on a bordeaux rectangle with a light yellow streak of light emanating from the letter “L”.
