The United States Patent and Trademark Office (USPTO) received a request to divide, and the amendment to allege use on December 7, 2022.  The request to divide and amendment to allege use cannot be processed for the reason(s) set forth below.

 

Applicant must clarify whether “Downloadable online digital media in Class 9; Providing an interactive website featuring news and information in the fields of general interest news; in Class 35 and providing online non-downloadable publications and educational services in Class 41” should be based on use in commerce or remain based on intent to use.

 

Accordingly, the request to divide and the amendment to allege use cannot be processed until the applicant resolves the issue stated above.  Applicant’s response to this Office action must be received in the United States Patent and Trademark Office within thirty (30) days from the issuance date of this letter.
