In response to the substantive refusal(s), please note the following:

In response to the Office Action issued on September 15, 2022 whereby registration for the subject mark TOMMY was refused due to a likelihood of confusion with U.S. Registration No. 6754750 for the mark TOMMIE, the Applicant hereby submits a consent agreement from the owner of the cited registration, Commune Hotels and Resorts, LLC, consenting to the Applicant's use and registration of the subject mark TOMMY, wherein Commune Hotels and Resorts, LLC and the Applicant have concluded that confusion is not likely to arise from their use and registration of their respective marks. In view of the foregoing, Applicant respectfully requests the Examining Attorney to allow the subject application to proceed to publication.
