Identification of Services
The wording “Publication of on-line information, videos, articles, and newsletters in the field of cryptocurrency infrastructure, scalability, security, and sustainability” in the Class 41 identification of services is unacceptable as it is indefinite, too broad as it identifies services in more than one class and does not adequately identify the services. See TMEP §§1402.01, 1402.03. This identification refers to publishing the works of others, e.g., Class 41-Publication of articles, and newsletters in the field of cryptocurrency infrastructure, scalability, security, and sustainability.
The “on-line information” and “videos” are not acceptable for publication services. If providing the content, the following changes are suggested: Class 41-Providing a website featuring non-downloadable articles, videos and newsletters in the field of cryptocurrency infrastructure, scalability, security, and sustainability; Class 41-Providing on-line information in the field of current events relating to cryptocurrency infrastructure, scalability, security, and sustainability; Class 36-Providing on-line financial information in the field of cryptocurrency infrastructure, scalability, security, and sustainability
For assistance with identifying and classifying goods and services in trademark applications, please see the USPTO’s online searchable U.S. Acceptable Identification of Goods and Services Manual. See TMEP §1402.04.
Email/Telephone for Inquiries
The USPTO does not accept emails as responses to Office actions; however, emails can be used for informal communications and are included in the application record. See 37 C.F.R. §§2.62(c), 2.191; TMEP §§304.01-.02, 709.04-.05.
