AMENDED IDENTIFICATION OF SERVICES REQUIRED
First, the services are classified incorrectly. Applicant must amend the application to classify the services in International Class 40. See 37 C.F.R. §§2.32(a)(7), 2.85; TMEP §§1401.02(a), 1401.03(b).
Next, the identification of services is indefinite and must be clarified to specify the nature of the services, as set out in bold below. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Applicant must amend the identification to specify the common commercial or generic name of the services. See TMEP §1402.01. If the services have no common commercial or generic name, applicant must describe or explain the nature of the services using clear and succinct language. See id.
Applicant may adopt the following wording, with changes highlighted in bold, if accurate:
Class 40 [reclassified] – “Oil and gas well treatment, namely, re-pressurization services to enhance oil and gas well fracturing operations”.
