Registration of this multi-class application was refused because the specimen submitted for Class 41 does not show the applied-for mark as actually used in commerce in connection with any of the services of that class. Accordingly, applicant concurrently files with this Office Action response a request to divide the application, Appl. No. 90/069,834, to allow classes 9, 16 and 35 to proceed to publication, and Class 41 to be examined as an intent-to- use application.
