Hi Diamond,

 

I’m the examiner for this application.  I had approved this back in March, but it’s been sent back to me for a missing color claim.  Specifically, the mark is shown in color, and the record includes a description of where the colors appear in the mark, but there is no color claim.  In fact, the application states “no” in the “Color Mark” field. 

 

Therefore, if you truly intended this to not be a color mark, you’d need to submit a new drawing of the mark showing it in only black and white, and we’d need to delete the references to color in the mark description.  Or I can just add a color claim for you for the colors gold and black via an “examiner’s amendment.”  If we go that route, I can make the change for you and get this back in the queue for publication.  I’d suggest the following, with a couple of changes to the mark description:

 

The colors yellow and black are claimed as a feature of the mark.

 

The mark consists of the word “VALENCE” in black and with a macron diacritic mark above the letter “A” in gold and surrounded in black.
