The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
The preliminary amendment including the wording “forklifts, tuggers” in the identification of goods for International Class 012 must be clarified because it is too broad and could include goods in other international classes. See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03. In particular, this wording could encompass “ power-operated lifting and moving equipment, namely, fork lifts ” and/or “material handling equipment in the nature of tuggers ” in Class 007 . Tuggers include equipment for moving equipment and material handling rather than vehicles. For example, see description of electric “tuggers” at http://www.ek-tech.com/material-handling/electric-tuggers/?gclid=EAIaIQobChMI5tPcx8719QIVls3ICh0taQWiEAAYAiAAEgKttfD_BwE.
Applicant may substitute the following wording, if accurate:
Power-operated lifting and moving equipment, namely forklifts and tuggers in Class 007 .
Forklift trucks in Class 012 .
