Search Results – Prior Pending Application

 

The filing date of pending U.S. Application Serial No. 90600666 precedes applicant’s filing date.  See attached referenced application.  If the mark in the referenced application registers, applicant’s mark may be refused registration under Trademark Act Section 2(d) because of a likelihood of confusion between the two marks.  See 15 U.S.C. §1052(d); 37 C.F.R. §2.83; TMEP §§1208 et seq.  Therefore, upon receipt of applicant’s response to this Office action, action on this application may be suspended pending final disposition of the earlier-filed referenced application.

 

In response to this Office action, applicant may present arguments in support of registration by addressing the issue of the potential conflict between applicant’s mark and the mark in the referenced application.  Applicant’s election not to submit arguments at this time in no way limits applicant’s right to address this issue later if a refusal under Section 2(d) issues.

 

Recitation of Services

 

The recitation of services is indefinite and must be clarified because they must be more clearly and concisely described.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Applicant may adopt the following identification, if accurate: 

 

Class 42: Platform as a service (PAAS) featuring an online computer software ecommerce platform used for connecting customers in any scientific discipline, allowing customers to obtain data and place orders for scientific research and facilitating communication with individual experts, academic core facilities, government labs and for-profit companies, and enabling online discussions and social networking; Design and development of on-line computer software systems, namely, design and development of an online data sharing, procurement and social networking and communications platform for scientists and research suppliers to share information, create custom studies, get price quotes, establish legal agreements and purchase research services and custom products; Platform as a service (PAAS) featuring an online social networking and communications software platform used to enable communication with potential customers, the exchange of information and selling of custom research services and products; Platform as a service (PAAS) featuring an online computer software platform used to manage both internal and external research sourcing projects and used for sharing of scientific information and institutional knowledge across a research organization through a central hub.

 

Applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods and/or services may not later be reinserted.  See TMEP §1402.07(e).
