I am the assigned trademark examining attorney for the above-referenced applications. I left you a voicemail this afternoon, but wanted to send an email in the event it would be easier for you and your client. The applications will move forward once the applicant (1) amends the mark description in all three applications because the current descriptions do not describe sufficiently the design elements show below, and (2) disclaims the wording KLIP and THE PET SOCIAL APP in two applications for being descriptive of applicant’s goods.
1. Mark Description
The current description of the design elements – “The mark consists of a stylized paw print.”
The proposed description of the design elements – “The mark consists of a stylized paw print featuring a stylized heart, all contained within a speech bubble.”
2. Disclaimer Statement
Applicant must disclaim the wording KLIP (in its correct spelling as CLIP) in Application Nos. 90680490 (KLIP THE PET SOCIAL APP) and 90739065 (KLIP) because KLIP immediately informs consumers that the software is used for social networking via sharing video clips. Additionally, applicant must disclaim the wording THE PET SOCIAL APP, in addition to KLIP, in Application No. 90680490 (KLIP THE PET SOCIAL APP) because the goods involve “mobile applications for social networking” featuring pets.
