USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

 

Application has been amended as shown below.  As agreed to by Catherine T. Dobrowitsky on June 2, 2021, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

 

Identification of the Goods and Services

The identification of goods and services is amended to read as follows: 

 

 

“Collapsible protective helmets for distribution through bicycle or scooter ride sharing services; Protective helmets that fold flat for portability and storage; Protective helmets that fold flat to vend; Protective helmets sold flat that open and expand when placed on the user's head; Protective helmets sold flat featuring a mesh that contours to the user's head when worn and folds flat for storage or portability; Collapsible protective helmets; Collapsible protective helmets intended for temporary use; Disposable protective helmets intended for temporary use; Disposable protective helmets intended for distribution through bicycle or scooter ride sharing services; Collapsible or foldable protective helmets that are recyclable; Motorized scooter helmets; Electric scooter protective helmets; Moped protective helmets; Push scooter protective helmets; Protective helmets for self-balancing two-wheeled electric scooters; Downloadable mobile software application that enables users to obtain collapsible, foldable, or disposable helmets at certain locations; Downloadable mobile software application that enables users to obtain collapsible, foldable, or disposable helmets and also provides bicycle or scooter ride sharing services systems interactions; Downloadable mobile software application that enables users to obtain collapsible, foldable, or disposable helmets in conjunction with bicycle or scooter ride share services; Downloadable mobile software application that enables users to obtain collapsible, foldable, or disposable helmets at certain locations, and also provides alerts, texting, phone-to-phone communications, and bicycle or scooter ride sharing services systems interactions” in International Class 9;

 

“Providing vending machines and retail vending stand services featuring collapsible, disposable, or folding helmets for distribution through bicycle ride sharing services; Providing vending machines and retail vending stand services featuring helmets that fold flat; Providing vending machines and retail vending stand services featuring helmets intended for temporary use, collapsible helmets, foldable helmets, and helmets that are recyclable; Retail vending stand services featuring disposable helmets, helmets intended for temporary use, collapsible helmets, foldable helmets, and helmets that are recyclable; Promotional services, namely, distribution of collapsible or foldable helmets featuring advertising and promotional items of others; Promotional services, namely, distribution of disposable helmets featuring advertising and promotional items of others; Retail, online retail, and pop-up retail store services featuring foldable helmets, collapsible helmets, and helmets sold flat; Retail, online retail, and pop-up retail store services featuring foldable helmets, collapsible helmets, and helmets sold flat that are recyclable; Providing consumer information in the field of helmet use and safety” in International Class 35.
