In response to this Office action, applicant may present arguments in support of registration by addressing the issue of the potential conflict between applicant’s mark and the mark in the referenced application. Applicant’s election not to submit arguments at this time in no way limits applicant’s right to address this issue later if a refusal under Section 2(d) issues.
REQUIREMENT TO AMEND DESCRIPTION AND CLASSIFICATION OF SERVICES
Transmission of podcasts is in Class 38, while production of podcasts is in Class 41. The applicant must clarify the nature of the podcasting services and classify them accordingly. Since this application includes both Classes 38 and 41, the applicant may adopt either or both of the following, without incurring any additional fees. Please note that suggested changes are in bold:
Class 9: no changes required
Class 38: Radio broadcasting services; broadcasting services, namely, streaming of audio material via the Internet; podcasting services, namely, transmission of podcasts
Class 41: Radio programming, namely, scheduling of programs to be broadcast on the radio and streamed via global computer network; providing news in the fields of music, sports, entertainment, and current events via a global communication network, the Internet, websites, podcasts, webcasts, webisodes, blogs, portable and wireless communication devices; Entertainment services, namely, providing podcasts in the fields of music, news, sports, comedy, entertainment and current events; podcasting services, namely, production of podcasts.
Class 42: no changes required
