The referenced application has been reviewed by the assigned trademark examining attorney.
USPTO database searched. The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no similar registered marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d). However, a mark in a prior-filed pending application may present a bar to registration of applicant’s mark. See attached Application Serial No. 87819877. Immediately following this Examiner’s Amendment, applicant will receive a Notice of Suspension based on this prior-pending application.
Application has been amended as shown below. As agreed to by Jeffrey S. Becker, attorney for applicant, on March 29, 2021, the examining attorney has amended the application as shown below. Please notify the examining attorney immediately of any objections. TMEP §707. Otherwise, no response is required. Id. In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted. 37 C.F.R. §2.71(a).
The following description of the mark is added to the record:
The mark consists of a stylized block letter “M” below two chevrons that point down. The chevrons are vertically aligned with the V-shaped part of the letter “M” and with each other.

WHAT HAPPENS NEXT
After issuance of this Examiner’s Amendment, the trademark examining attorney will immediately suspend the application based on the prior-pending application mentioned above.
