Applicant states for the record that JHO Intellectual Property Holdings, LLC, Elite IP Holdings, LLC, and Entourage IP Holdings, LLC are all commonly owned by Vital Pharmaceuticals. Each entity is an IP holding company for Vital and Vital enjoys an exclusive license of all of the entities' properties. Each company has the same officers and individuals advising the entities. Accordingly, there is unity of control of all marks owned by JHO, by Entourage, and by Elite and none of the marks owned by any of the entities should be cited to reject the marks of any other entity. Appplication No. 88/844,605 is commonly owned.
