A petition to the Director of the United States Patent and Trademark Office (USPTO) for consideration of an amendment to the basis of the application was received on May 4, 2021.
The petition is hereby dismissed as moot.
On May 4, 2021, petitioner filed a petition to amend the basis of the application from Section 1(b) to Section 44(e). A review of the record shows that the foreign registration was accepted prior to publication and the application is based upon both Section 1(b) and Section 44(e). Therefore, the petition is dismissed as moot.
The petition fee received on May 4, 2021 will be refunded. The application file will be forwarded to the Intent to Use unit to delete the Section 1(b) basis and pass the application to registration.
