Dear Ms. Musa,

 

I am the Trademark Examining Attorney at the U.S. Patent and Trademark Office reviewing the application set forth above.  Before I can move the application forward, the following issue needs to be addressed:

 

Identification of Goods – Class 9

 

The identification of goods in International Class 9 is indefinite.  The function of the downloadable mobile applications must be further clarified, e.g., what they do / what they allow the user to do. 

 

For the function of the online marketplace and e-marketplace software, wording such as “providing” and “accessing” would be sufficient to clarify the function.  For the e-commerce software, more clarification of the function is necessary, such as “to allow users to perform electronic business transactions via a global computer network”. 

 

Additionally, the wording “e-marketplace” should be clarified as “electronic marketplace.

 

The following wording with changes shown in bold would be acceptable, if accurate:

 

Class 9:            Downloadable mobile applications for providing and accessing an online marketplace; Downloadable mobile applications for e-commerce to allow users to perform electronic business transactions via a global computer network; Downloadable mobile applications for providing and accessing an electronic marketplace

 

If you can respond by email or telephone by Friday February 5, 2021, this requirement may be resolved through the issuance of an Examiner’s Amendment.  Otherwise, a formal Office Action will be issued, and you will have six (6) months to respond.
