EXAMINER’S AMENDMENT

Application has been amended as shown below.  As agreed to by Julie A. McGinnis, a qualified practitioner from the same firm as the as the practitioner of record, on March 10, 2021, the examining attorney has amended the application as shown below.  TMEP §707.01.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and services are not permitted.  37 C.F.R. §2.71(a).

The identification of goods in International Class 10 is amended to read as follows:

International Class 10:  Blood collection kit comprised of blood collecting tubes for use in the fields of oncology and tumor identification, analysis, and treatment; tissue collection kit comprised of tissue collecting containers, for use in the fields of oncology and tumor identification, analysis, and treatment.

See TMEP §§1402.01, 1402.01(e).  The identification of goods and services in International Classes 5, 42, and 44 remain unchanged by this Examiner’s Amendment.
