Good morning Mr. Rhynhart:
I have reviewed the request for reconsideration filed in the above-referenced application(s). There are still some issue(s) that must be addressed before the application can be approved to proceed to publication. I am hoping we can figure this out and do an Examiner’s Amendment to avoid me having to deny the request for reconsideration and abandon the application (unless a Notice of Appeal was filed by 11/29/21 that I am unaware of).
This writing follows a voice-message left for you earlier this week.
(1) IDENTIFICATION AND CLASSIFICATION OF SERVICES FOR CLASS 42 – The wording “Providing an interactive computer database, website and portal for insurance agents featuring information to conduct insurance sales activities, sell insurance policies, and enroll new members” is not correctly classified in Class 42. As discussed in the final Office action of 5/29/21, these types of services are classified according to their subject matter or field of use. This wording would not be appropriate for Class 42, but also must be further clarified to determine the correct classification because it is too broad and could include contact information in Class 35, such as “Providing commercial and business contact information” in Class 35. However, it could also include “insurance information” in 36.
The following amended wording and classification is proposed (changes underlined):
CL36 - Providing an interactive computer database, website and portal for insurance agents featuring insurance information for conducting insurance sales activities, selling insurance policies, and enrolling new members
I can enter the above proposed changes by Examiner’s amendment, with your approval.
However, I need to act on this application by the end of this weekend, so please respond with your instructions ASAP, if possible, but by Sunday night at 5:00pm at the latest. If you are unable to respond by that time, I will send an Office action making this requirement, but am still happy to do an Examiner’s amendment at a later date.
