USPTO database searched; no conflicting marks found. The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d). 15 U.S.C. §1052(d); TMEP §704.02.
Application has been amended as shown below. As agreed to by Sara M. Bauer on January 28, 2021, the examining attorney has amended the application as shown below. Please notify the examining attorney immediately of any objections. TMEP §707. Otherwise, no response is required. Id. In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted. 37 C.F.R. §2.71(a).
The identification of goods is amended to read as follows: “Downloadable computer programs for implementing a computer programming language; downloadable electronic publications in the nature of instructional materials, white papers, presentations, and manuals in the fields of computer software and software development; downloadable software development tools; downloadable computer software for use in designing, developing and deploying other computer software; downloadable computer software utilities that facilitate writing, testing, configuring, and monitoring other programs; downloadable computer software for running web and mobile applications; downloadable computer software for use as an application program interface (API); downloadable machine learning software for probabilistic modeling; downloadable deep learning software for probabilistic modeling; downloadable artificial intelligence software for probabilistic modeling.” See TMEP §§1402.01, 1402.01(e).
The following description of the mark replaces the current description of record:
The mark consists of the stylized Greek letter "pi" in red overlapping with the stylized Greek letter "rho" appearing in yellow with the overlapping portion appearing in orange. The color white represents background, outlining, shading, and/or transparent area and is/are not part of the mark.
