Disclaimer Advisory

 

In the May17, 2021 response, applicant voluntarily disclaimed the following matter in the applied-for mark:  “CHOCOLATE.”  An applicant may voluntarily disclaim matter in a mark regardless of whether the matter is registrable.  TMEP §1213.01(c); see 15 U.S.C. §1056(a).  However, a disclaimer of this matter is not required.  Furthermore, the disclaimer does not overcome the Section 2(d) likelihood of confusion refusal or the potential Section 2(d) likelihood of confusion refusal explained in the December 14, 2020 Office action.

 

Therefore, applicant may request to withdraw this disclaimer from the application.  If applicant does not expressly request its withdrawal, the disclaimer will remain in the application and will be printed on the registration certificate.

 

Suspension process.  The USPTO will periodically check this application to determine if it should remain suspended.  See TMEP §716.04.  As needed, the trademark examining attorney will issue a letter to applicant to inquire about the status of the reason for the suspension.  TMEP §716.05.
