Applicant proposes to amend the mark as follows:

Proposed: RIPPLEX (Stylized and/or with Design, see mark)
The applicant is not claiming color as a feature of the mark.
The mark consists of the word "RIPPLEX" all in lower case letters immediately preceded by three connected circles.

EVIDENCE
Evidence has been attached: Applicant Ripple Labs, Inc. ("Ripple Labs" or "Applicant"), by and through counsel, hereby responds to the Office Action issued on September 30, 2020 (the "Office Action"). In the Office Action, the Examiner raises Application Serial Nos. 88546075 and 88661982 as potential barriers to registration for the subject mark pertaining to services in Class 36. Elsewhere in this response, Ripple Labs has appended claim of multiple prior registrations for RIPPLE and RIPPLE-variants marks for services in Class 36 that precede the filing dates of both the '075 and '982 applications. Moreover, the '982 application is itself subject a 2(d) citation based on filings owned by Ripple. Based on the foregoing, Ripple respectfully requests the prior-pending application objections be lifted.
