ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

The Applicant appreciates the Examiner's time in reviewing and responding via telephone. With regard to the Section 2(d) refusal (the sole remaining issue), as noted via telephone Applicant has filed a Petition to Cancel the cited mark, U.S. Registration #5893873. The Petition to Cancel is based, in part, on the Registrant's apparent abandonment of the mark, and apparent cessation of activity. It would further appear that the registration is invalid for the Registrant's failure to use the mark with all of the listed goods and services, including those relating to "transdermal drug delivery patches." Based on the Examiner's indications, the Applicant understands that the instant application will be placed into suspension, pending the outcome of the Petition to Cancel.
