I am the trademark examining attorney assigned to review the applications for Serial Nos. 90070036 – BETTERFED BEEF and 88945518 – DEFIANCE BEEF.
I have reviewed the applications, and they look good. There is just one outstanding issue with these applications that I was hoping to resolve with you by issuing an Examiner’s Amendment. An Examiner’s Amendment is a tool I can use to expedite the trademark application process. To do so, I need your authorization to make the following amendment to the application.
Specifically, the wording “BEEF” must be disclaimed in each mark because applicant’s identified goods are “beef”. A disclaimer statement simply acknowledges that you are not claiming the exclusive right to use the word BEEF in connection with the applied-for goods. It does not delete this wording from your trademark. The following disclaimer statement is proposed:
No claim is made to the exclusive right to use the wording “BEEF” apart from the mark as shown.
