The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

SEARCH OF USPTO DATABASE OF MARKS

The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

IDENTIFICATION OF GOODS/SERVICES

The identification of goods/services is indefinite and must be clarified because the nature of the goods/services cannot be ascertained and accurately classified.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  The applicant must specify the type of Class 9 components as indicated below.  Please note that events and conferences must be further specified and correctly classified as business events and conferences are in Class 35, while those services for educational or entertainment purposes are in Class 41.

 

The applicant must clarify the wording in Class 42: “providing…a web site featuring a wide variety of educational topics and subjects for network-based delivery of content to global computing, mobile electronic and optical devices.”  If applicant is providing information via the Internet, such as on a website, the subject matter of the information being provided determines classification of these services.  See TMEP §1402.11(a)(ii).  Therefore, applicant must amend the identification to specify the subject matter of the information being provided via the Internet and the proper classification.  See id.

Applicant may adopt the following identification, if accurate:

Applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods and/or services may not later be reinserted.  See TMEP §1402.07(e).

 

The application identifies goods and/or services in more than one international class; therefore, applicant must satisfy all the requirements below for each international class based on Trademark Act Section 1(b):

 

(1)        List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.

 

(2)        Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule).  The application identifies goods and/or services that are classified in at least 4 classes; however, applicant submitted a fee(s) sufficient for only 3 classes.  Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

EXPLANATION OF MARK’S SIGNIFICANCE REQUIRED

To permit proper examination of the application, applicant must explain whether the wording “AMYNA” in the mark has any significance in the applicant’s trade or industry or as applied to applicant’s goods and/or services, or if such wording is a “term of art” within applicant’s industry.  See 37 C.F.R. §2.61(b); TMEP §814.  Failure to comply with a request for information is grounds for refusing registration.  In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814.

 

PLEASE NOTE:  Applicant is encouraged to telephone or email (Tracy.Cross@uspto.gov) the trademark examining attorney to resolve the issues raised above, if a new class is not being added.  Formal responses are not accepted via email.  However, in this case, the examining attorney will issue an examiner’s amendment based upon the applicant’s informal email communication.
