EXAMINER’S AMENDMENT

USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

 

Application has been amended as shown below.  In accordance with TMEP §707.02, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

 

The trademark examining attorney is amending the application as follows.  No prior approval or authorization from applicant or applicant’s attorney is required.  TMEP §707.02.

 

AMENDMENT OF IDENTIFICATION OF SERVICES

 

The application identification of services is amended to delete the duplicate entry in the identification of services in International Class 41 for “Entertainment services in the nature of live musical performances;”.  See TMEP §707.02.  The second entry has been deleted from the identification. 

 

The identification of services for International Class 41 is amended to read as follows:

 

Entertainment event booking agencies; Entertainment in the nature of live performances by music artists; Entertainment information services, namely, providing information and news releases about a musical artist; Entertainment media production services for motion pictures, television and Internet; Entertainment services by a musical artist and producer, namely, musical composition for others and production of musical sound recordings; Entertainment services in the nature of arranging social entertainment events; Entertainment services in the nature of development, creation, production and post-production services of multimedia entertainment content; Entertainment services in the nature of development, creation, production, distribution, and post-production of music; Entertainment services in the nature of hosting social entertainment events; Entertainment services in the nature of live audio performances by music artists; Entertainment services in the nature of live musical performances; Entertainment services in the nature of live visual and audio performances, namely, musical, variety, news and comedy shows; Entertainment services in the nature of live vocal performances by music artists; Entertainment services in the nature of organizing social entertainment events; Entertainment services, namely, multimedia production services; Entertainment services, namely, providing information about a recording artist via an online network; Entertainment services, namely, providing podcasts in the field of music; Entertainment, namely, live music concerts; Entertainment, namely, live performances by a musical band; Entertainment, namely, live performances by musical bands; Multimedia entertainment services in the nature of recording, production and post-production services in the fields of music, video, and films; Organization of exhibitions for musical entertainment; Providing entertainment information via a website; Providing information in the field of entertainment; Providing information, news and commentary in the field of entertainment.
