OFFICE ACTION
TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.
ISSUE/MAILING DATE: 12/22/2018
The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
Search Results
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
Recitation of Services
Applicant may substitute the following wording, if accurate:
Class 36
Real estate services, namely, rental, brokerage, leasing and management of commercial property, offices and office space for health and fitness clubs, entertainment and exhibition spaces, retail spaces, and restaurant and bar spaces.
Class 41
Art exhibitions; Entertainment services, namely, live performances by (specify, e.g., musical band, rock group); Entertainment services in the nature of an amusement park attraction, namely, a themed area; Entertainment services, namely, conducting guided tours of (indicate facility, e.g., a museum, an historical site, a winery, etc.); educational services, namely, conducting on-line exhibitions and displays and interactive exhibits in the field of (indicate subject matter or field),; educational services, namely, providing classes, seminars, workshops, focus groups, and courses of instruction featuring experiential learning events in the field of (specify).
Applicant may amend the identification to clarify or limit the services, but not to broaden or expand the services beyond those in the original application or as acceptably amended. See 37 C.F.R. §2.71(a); TMEP §1402.06. Generally, any deleted services may not later be reinserted. See TMEP §1402.07(e).
ID Manual Online
For assistance with identifying and classifying goods and services in trademark applications, please see the USPTO’s online searchable U.S. Acceptable Identification of Goods and Services Manual. See TMEP §1402.04.
Request for Information
Factual information about the services must clearly indicate what the services are and how they are rendered, their salient features, and their prospective customers and channels of trade. Conclusory statements regarding the services will not satisfy this requirement for information.
In addition, applicant must respond to the following questions: “Is CATALOG a term of art in the industry as applied to the services? Does applicant’s services include the provision of CATALOG featuring real estate used by those who rent, sell or manage property, and/or catalogs put out by the people who organize art exhibitions?
Failure to comply with a request for information is grounds for refusing registration. In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814. Merely stating that information about the goods and services is available on applicant’s website is an insufficient response and will not make the relevant information of record. See In re Planalytics, Inc., 70 USPQ2d 1453, 1457-58 (TTAB 2004).
