Applicant received a Final Office Action dated February 26, 2020 refusing registration for International Class 9 on the grounds that the Class 9 specimen submitted with the Amendment to Allege Use is not acceptable as a display associated with downloadable software and does not show the applied-for mark as actually used in commerce. Applicant hereby requests to divide this application to create one (1) Parent and one (1) Child application. The Parent application should retain all claimed goods in Class 9. The Child application should retain all claimed services in Class 42. Concurrent with this division, Applicant respectfully requests that the outstanding office action be withdrawn with respect to the Child application, and that the Child application proceed to registration.
