ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

The Examiner has requested that Applicant separately file an Amendment to Allege Use in Class 25. Applicant has filed the Amendment to Allege Use along with a Request to Divide, and has attached the same as Evidence. Class 25 will now be moved into a separate child application. Parent application 8845350 should now be in a position to move forward to Allowance in Classes 5, 21, 32, 35, and 41. This should satisfy all issue raised in the Office Action.
