The examining attorney has refused registration of Applicant's mark QUEEN ANNE based on a likelihood of confusion. Per Applicant Attorney's
February 13th e-mail and subsequent May 14th telephone conversation with the examining attorney, it is respectfully submitted that the noted infringing goods which fall within Classes 024, 025, 030
& 033 in Applicant's Class 035 identification of services has been deleted. Therefore, it is respectfully requested that refused as to the cited marks US Registration Nos. 0039438 (Class 033),
1199758 (Class 030); 1260053 (Class 025) and 2906927 (Class 024) be withdrawn. With respect to the other cited mark - QUEEN ANNE'S REVENGE STEAK & SEAFOOD (Reg. No. 2605744) for restaurant and
bar services in Class 042, it is respectfully argued that the commercial impressions of the respective parties' marks are quite distinct. Specifically, QUEEN ANNE'S REVENGE was the name of the famous
ship captained by the infamous pirate Blackbeard. Blackbeard's Queen Anne's Revenge sailed along the North Carolina coast and shipwrecked there. Hence, the name and location of the registrant's North
Carolina pirate theme restaurant pays tribute to the pirate. See attached pdf files. In contrast, Applicant's mark QUEEN ANNE is in reference to the 18th century British queen - Queen Anne. See
attached pdf file. As discussed, Applicant (Cunard) has a present fleet with ships named QUEEN ELIZABETH, QUEEN MARY and QUEEN VICTORIA. Its co-pending US applications are for QUEEN ISABELLE and KING
JAMES. Thus, it is clear that the inspiration of this British cruise line is to name ships after famous members of the royal family. For the foregoing reasons, it is respectfully requested that these
cited marks be withdrawn and the application passed to publication. |

The examining attorney has refused registration of Applicant's mark QUEEN ANNE based on a likelihood of confusion. Per Applicant Attorney's February 13th e-mail and subsequent May 14th telephone
conversation with the examining attorney, it is respectfully submitted that the noted infringing goods which fall within Classes 024, 025, 030 & 033 in Applicant's Class 035 identification of
services has been deleted. Therefore, it is respectfully requested that refused as to the cited marks US Registration Nos. 0039438 (Class 033), 1199758 (Class 030); 1260053 (Class 025) and 2906927

Blackbeard's Queen Anne's Revenge sailed along the North Carolina coast and shipwrecked there. Hence, the name and location of the registrant's North Carolina pirate theme restaurant pays tribute to
the pirate. See attached pdf files. In contrast, Applicant's mark QUEEN ANNE is in reference to the 18th century British queen - Queen Anne. See attached pdf file. As discussed, Applicant (Cunard)
has a present fleet with ships named QUEEN ELIZABETH, QUEEN MARY and QUEEN VICTORIA. Its co-pending US applications are for QUEEN ISABELLE and KING JAMES. Thus, it is clear that the inspiration of
this British cruise line is to name ships after famous members of the royal family. For the foregoing reasons, it is respectfully requested that these cited marks be withdrawn and the application
passed to publication.
