Subject: USPTO Miami Marlins Applications

Hi Benji,

Appreciate you taking the time to speak with me yesterday regarding the pending Miami Marlins applications. As we discussed, we would like to resolve the pending applications assigned to you (see chart below) via Examiner’s Amendments in the same manner the companion applications were handled by Examiner Cheryl Clayton (Section 2f claims and ID amendments). The applications (Serial Nos. 88196022, 88196014, 88195937, 88195905, 88195891) that were handled by Cheryl Clayton were approved for publication, made it through secondary review, and currently are in the NOA stage. I have attached the Note to File entered by Cheryl Clayton indicating she would reach out to you and the third examiner so that all the applications could be handled uniformly. I have also spoken with Ron Fairbanks who is aware of the situation.

Below (and attached) you will find a chart with all of the applications assigned to you with the actions that we would like to take on each application. Please ignore the # column as that is for our internal tracking. The identification amendments for each application/class are below the chart. Four of the applications only have identification issues. As we are coming up against our response deadlines, we appreciate if could enter the EAs as soon as feasible in case we must address any last minute minor issues before the deadline.

Please let us know if you have any questions. Thank you for your assistance.

Regards,

Jeff
