I write in regards to the pending IMPOSSIBLE TASTE PLACE trademark applications in Class 35. Lisa Greenwald-Swire is currently out of the office, but I am an associate on her team and one of the “Other Appointed Attorneys” listed in the applications.
My understanding is that there is only one portion of this ID that still needs to be revised, namely:
administering a {“loyalty” is not acceptable here, this needs to be a specific good(s) such as wine, cheese, burgers, etc.} club by means of selecting said goods based on consumer expectations and arranging periodic shipment to club members
We spoke with our client and confirmed that this language can be removed. Can you make the changes via Examiner’s Amendments?

My apologies for the delayed response. I reviewed your suggested amendment. It is mostly acceptable with some deletion of duplicate wording and brackets. However, the one entry that needs additional revision is the service “administering a {loyalty} club by means of selecting said goods based on consumer expectations and arranging periodic shipment to club members.” This is a “goods” based subscription-type club service such as wine, cheese, and books, therefore, we do need specific “good(s)” in place of “loyalty.”
Below is my proposed identification with my edits. If you approve the changes and provide the specific goods to replace “loyalty” in the below highlighted ID, I can amend the relevant applications and move them towards publication.
