EXAMINER’S AMENDMENT
Issue date: July 29, 2019
APPLICATION HAS BEEN AMENDED: As agreed to by applicant's attorney David S. Jacobson on July 29, 2019, the examining attorney has amended the application as shown below.
The identification of goods in International Classes 20 and 24 are amended to read as follows:
CLASS 20: Pet Crates, Beds for household pets, Cat Scratching Pads, Cat scratching posts, Pet crate pads in the nature of cushions; Mats intended as beds for household pets
CLASS 24: Reusable housebreaking pads of fabric for pets
See TMEP §§1402.01, 1402.01(e). The identification of goods may be clarified or limited, but not added to or broadened. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.
Please advise the undersigned examining attorney immediately if there is an objection to the amendment. Otherwise, no response is necessary. TMEP §707.
WHAT HAPPENS NEXT: After this Examiner’s Amendment is issued, the mark will be approved for publication in the USPTO’s Trademark Official Gazette, a weekly online publication. Although rare, withdrawal of approval prior to publication can occur after the USPTO conducts its final review of this application. Unless withdrawal occurs, applicant will next receive a “Notice of Publication” specifying the date on which the mark will be published in the Trademark Official Gazette. The USPTO publishes applicant’s mark in the Trademark Official Gazette to provide third parties who believe they may be damaged by the registration of applicant’s mark an opportunity to oppose registration of the mark within thirty (30) days from the publication date.
If no party files an opposition, the USPTO will next issue a “Notice of Allowance” approximately eight (8) weeks after the date the mark was published. Applicant will then have six (6) months from the date the Notice of Allowance was issued to file either a “Statement of Use” or a request for an “Extension of Time to file a Statement of Use” (“extension request”). Forms for Statements of Use and extension requests are available online at Intent to Use (ITU) Forms. A registration certificate will not issue until the applicant files a Statement of Use and it is approved by the USPTO.
