EXAMINER’S AMENDMENT

Issue date:  September 05, 2019

USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

Application has been amended as shown below.  As agreed to by James Struthers on September 4, 2019 the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

AMENDMENT TO IDENTIFICATION LANGUAGE

The identification of services language in International Class 041 is hereby amended to the following: 

“Entertainment, namely, live performances by vocalists; entertainment, namely, hosting online live vocal musical performances; Entertainment in the nature of online live singing and karaoke performances; Entertainment services, namely, providing a website featuring online non-downloadable music vocal performances in the nature of an online vocal performance platform; Providing an Internet website portal in the field of entertainment featuring online singing and karaoke; Providing an Internet website portal in the field of entertainment featuring online non-downloadable music and karaoke music, not downloadable; Entertainment information; Entertainment services, namely, providing information in the field of music, karaoke music and online musical performances; Entertainment services, namely, providing online video games; Providing online non-downloadable game software; Entertainment services, namely, providing a virtual environment in which users can interact for recreational, leisure or entertainment purposes; Entertainment in the nature of competitions in the field of vocal performance.”  See TMEP §§1402.01, 1402.01(e).

Please note that the identification language for International Classes 009, 038, 042 & 045 also listed in this application are acceptable as they currently appear in the record and all proceed forward without amendment. The record for this application is hereby amended to reflect the authorized changes listed above.
