PETITION TO MAKE SPECIAL

Applicant of U.S. Application Serial No. 88440444 for the Mark "Newfield" files this Petition to Make Special based on the following facts:

• The Applicant's long standing registration for the same Mark "Newfield" (U.S. Registration Serial No. 3487759) lapsed unintentionally in March, 2019. Applicant learned of the lapse in May, 2019, and immediately refiled for the Mark in U.S. Application Serial No. 88440444 

• Applicant has used the mark continuously since January, 1991 

• The original registration was renewed in 2013, after its 5-6th year Section 8 & 15 renewals; it was and is Applicant's intention to maintain its registration of the Mark

• Applicant has several Madrid Protocol international registrations (No. 0981988) based on its U.S. registration which must be maintained 

• Applicant's current U.S. Application Serial No. 88440444 reflects the same Classifications, descriptions of services, and dates of first use as U.S. Registration No. 3487759 

• On information and belief, there are no other users of or challengers to the Mark 

Based on the foregoing, Applicant respectfully requests expedited review of the instant application based on its prior U.S. Registration Serial No. 3487759 and its international registrations.
