Dear Ms. Howard:

 

I have reviewed the above-referenced case, and there is only one issue that must be resolved before I can approve it for publication.  Specifically, I need a disclaimer of “DATA HUB” since this wording is merely descriptive of the intended purpose and/or function of the applicant’s goods and services, as even defined in the applicant’s specimen of use. 

 

Therefore, the following disclaimer statement is proposed:

 

No claim is made to the exclusive right to use “DATA HUB” apart from the mark as shown.

 

I can enter this statement by Examiner’s amendment.  However, I do need to act on this case ASAP (today) since it is already overdue in my docket.  Therefore, please respond no later than 2:00pm EST TODAY with your approval, if you are able to do that.  If you cannot respond that quickly, I totally understand, and I will issue an Office action making this requirement, but am still happy to do an Examiner’s amendment at a later date.
