INTRODUCTION
This Suspension Notice is in response to the applicant’s Response to Office Action filed on January 29, 2021.
In the initial Office action of August 27, 2020, the examining attorney issued a Section 2(d) likelihood of confusion refusal and required the applicant to submit a substitute specimen. The applicant also was advised of prior-filed and pending applications that may be the subject of another Section 2(d) refusal should those applications register.
As an initial matter, the requirement that the applicant submit a substitute specimen is WITHDRAWN. Additionally, the applicant argued against the refusal, which the examining attorneys find unpersuasive. Accordingly, the Section 2(d) refusal is MAINTAINED AND CONTINUED, and the application is SUSPENDED for the reason specified below. See 37 C.F.R. §2.67; TMEP §§716 et seq.
The pending applications below have earlier filing dates than applicant’s application. If the marks in the applications below register, the USPTO may refuse registration of applicant’s mark under Section 2(d) because of a likelihood of confusion with the registered marks. 15 U.S.C. §1052(d); see 37 C.F.R. §2.83; TMEP §1208.02(c). Action on this application is suspended until the prior-filed applications below either register or abandon. 37 C.F.R. §2.83(c). Information relevant to the applications below was sent previously.
