United States Trademark Application Serial No. 88897761 “ZORA” / Docket No. 10048-00003

Dear Mr. Rosario,

I am the assigned trademark examining attorney for the above-referenced application.  The application will be ready to proceed once the identification of goods and services in Classes 9 and 42 is modified for improved clarity and definiteness and in order to meet USPTO requirements.  Specifically, applicant must clarify the nature of the “tools” in both classes, and the parentheses must be removed from the identifications to avoid confusion with the USPTO’s practice of using them in registrations to indicate deleted goods. Please note that the parentheses around the term (DApps) are acceptable because such wording appears in the USPTO ID Manual.

If the changes below are acceptable, I will issue an examiner's amendment and move the application towards publication accordingly.

·         Class 9: Downloadable mobile applications for allowing individuals to come together to buy and sell digital tokens that represent real world goods, and downloadable computer software development tools to enable people to create and operate their own decentralized autonomous organizations (DAOs); Downloadable computer application software for mobile phones, namely, software for allowing individuals to come together to buy and sell digital tokens that represent real world goods, and downloadable computer software development tools to enable people to create and operate their own decentralized autonomous organizations (DAOs); Downloadable computer application software for mobile phones, tablets, and other handheld devices, namely, software for allowing individuals to come together to buy and sell digital tokens that represent real world goods, and downloadable computer software development tools to enable people to create and operate their own decentralized autonomous organizations (DAOs)

·         Class 42: Providing temporary use of non-downloadable web-based decentralized applications (DApps) for allowing individuals to come together to buy and sell digital tokens that represent real world goods, and providing temporary use of on-line non-downloadable software development tools to enable people to create and operate their own decentralized autonomous organizations (DAOs)

See TMEP §§1402.01, 1402.01(e).

Please let me know by phone or email as soon as possible, but no later than the close of business on Thursday, July 30th,  if you agree to allow me to correct the above by an examiner's amendment or if you have any questions about the application.

Thank you!
