Subject: Re Trademark Application for CLEANSWEET, #88884030

Dear Ms. Redfield

I am the trademark examining attorney to whom this application has been assigned. There are minor issues that we can resolve by examiner's amendment, based on your reply to this email or a phone call.

The identification of goods listed as “zero-calorie sweeteners derived through fermentation of cane syrup” in Class 30 is broad enough to include goods in Class 1 (artificial sweeteners) or Class 30 (natural sweeteners).  The applicant must clarify the goods and classify them accordingly.  They may amend to either or both of the following, if accurate:

Class 1:                 artificial sweeteners, namely, zero-calorie sweeteners derived through fermentation of cane syrup

Class 30:               natural sweeteners, namely, zero-calorie sweeteners derived through fermentation of cane syrup

If the applicant chooses to keep the goods in one class, then I can enter the amended identification and classification via examiner’s amendment. If the applicant wishes to add a class, then I can do it via examiner’s amendment if your firm has a deposit account. Otherwise, I can issue a priority action, enter one class of goods and provide instructions for adding the second class.

Additionally, please state for the record whether CLEANSWEET has any industry meaning, or whether it is a coined term

Please tell me how you would like to proceed or if you have questions.  Thank you.
