Dear Mr. Bruzas,
I am the examining attorney assigned to the above-referenced application, and there are issues that must be resolved before I can move the application forward.
IDENTIFICATION OF GOODS AND/OR SERVICES
Some of the wording is indefinite and must be clarified because it doesn’t list the type of nuts in the snack mix, or properly order the snack mix based on the classification of each good. The class 029 items in the snack mix should come before anything outside of that Class.
The following amended identification of goods and/or services in Class 029 is suggested, if accurate, with changes highlighted in bold:
Class 029: Vegetable and nut based snack foods; fruit and nut based snack foods; snack mix consisting primarily of processed nuts, seeds, dried fruit, and also including processed grain and chocolate; plant-based snack foods, namely, snack mix consisting primarily of dried vegetables, processed nuts, seeds, dried fruit and also including chocolate
and dried-fruit
With your authorization to do so, I can add the amended identification via Examiner’s Amendment before moving the application along for publication review. Alternatively, if you would like additional time, I can also prepare a Priority Action that will detail the identification requirement.
Please let me know by WEDNESDAY, JUNE 3 if you have any questions or would like to discuss further, and which of the above options are acceptable. If I have not heard from you by then, I’ll move forward with an Office Action formalizing the above issues.
Best,
Keton Hansrajh
