ARGUMENT(S)
Question; To permit proper examination of the application, applicant must explain whether the wording ?POLYURETHANE-100? in the mark has any significance in the cosmetic trade or industry or as applied to applicant?s goods and/or services, or if such wording is a ?term of art? within applicant?s industry. See 37 C.F.R. ?2.61(b); TMEP ?814. Answer: The mark "Polyurethane-100" is specific and unique to Grant Industries, Inc. as it is the name of the patent pending material invented by Grant Industries, Inc. This wording is not a "term of art" within the cosmetic industry. It is specific to innovative material invented by the Applicant. Question: Additionally, applicant must answer the following question: Is ?polyurethane-100? an ingredient in applicant?s goods? Failure to comply with a request for information is grounds for refusing registration. In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP ?814. Answer: Yes. "Polyurethane-100" is the name of the patent pending material (ingredient) invented by the Applicant. Stated more clearly, "Polyurethane-100" is the name of the good.
