Applicant Shenzhen Ampere Time Technology Co., Ltd.. hereby responds to the United States Patent and Trademark Office Action dated June 23, 2020 (“Office Action”). In the Office Action, the Examining Attorney (“Examiner”) has cited a prior trademark application to could be a bar to Applicant’s AMPERE TIME and Design mark (Serial No. 88/847001) for Accumulators, electric; Accumulators, electric, for vehicles; Batteries, electric; Battery boxes; Chargers for electric batteries; Charging stations for electric vehicles; Computer hardware; Galvanic batteries; Humanoid robots with artificial intelligence; Photovoltaic cells; Solar batteries; Solar panels for the production of electricity; Vehicle radios; Wearable activity trackers in International Class 009 because of Trademark Application with Serial number 88/168,089 for AMPERE . Applicant respectfully submits that its mark is not likely to be confused with the cited marks for the reasons set forth below. I. No Likelihood of Confusion Exists
For likelihood of confusion to exist, consumer confusion as to the source of the goods must be probable, not simply possible. Cohn v. Petsmart, Inc., 281 F.3d 897, 842 (9th Cir. 2002) (internal citations omitted); see also Elvis Presley Enters., Inc. v. Capece, 141 F.3d 188, 193 (5th Cir. 1998) (‘Likelihood of confusion is synonymous with a probability of confusion, which is more than a mere possibility of confusion.”) (emphasis added). Likelihood of confusion between AMPRERE TIME and DESIGN and AMPERE is not probable because the common portions of the marks AMPERE or AMPER are widely used by third parties for related goods in class 09. The Differences in the Respective Marks Result in No Likelihood of Confusion. In comparing the AMPERE and Design and the cited Application for AMPERE, the marks must be considered in their entireties, rather than dissected or split into component parts, and each part compared with the other parts. In re Nat’l Data Corp., 753 F.2d 1056, 1058 (Fed. Cir. 1985) (“The basic principle in determining confusion between marks is that marks must be compared in their entireties [and thus] likelihood of confusion cannot be predicated on dissection of a mark, that is, on only part of a mark.”). No feature of the mark should be ignored. In re Electrolyte Labs, Inc., 929 F.2d 645,647 (Fed. Cir. 1990) (“No feature of a mark is ignored” in the likelihood of confusion analysis.) The commercial impressions marks convey may still be distinct, even where the marks possess elements in common with one another. Courts have consistently held that no likelihood of confusion exists between marks sharing a common term if the marks create a distinct commercial impression, as is true in this case. Shen Mfg. Co., Inc. v. The Ritz Hotel Ltd., 73 USPQ2d 1350 (Fed. Cir. 2004). Moreover, “[a]dditions or deletions to marks may be sufficient to avoid a likelihood of confusion if…the matter common to the marks is not likely to be perceived by purchaser as distinguishing source because it is merely descriptive or diluted.” TMEP 1207.01(b)(iii) (emphasis added).
The term AMPERE or AMPER, common between the marks, is diluted as applied to class 09 goods. Dilution and descriptiveness of a common element can be shown by the existence of several third-party registrations, or by evidence of actual third-party use. AMF Inc. v. American League Products, Inc. 474 F.2d 1403, 1406, 177 USPQ 268,269-7- (CCPA 1973); Palm Bay Imports, Inc. v. Veuve Clicquot Ponsardin maison Fondee En 1772, 396 F.3d 1369, 73 USPQ2d 1689, 1693 (Fed. Cir. 2005) (The existence of widespread third-party use under the duPont factors may serve to indicate the weakness of a term in the context of its source identifying significance). Here, there are at least fifteen (15) concurrent registrations for class 09 goods that include AMPERE or AMPER formative marks. See attached Exhibit A. As such, Applicant’s AMPERE TIME application combines a highly diluted term (AMPER). The registered marks are therefore subject to a narrow scope of protection. Therefore, it is particularly unlikely that consumers will confuse Applicant's AMPERE TIME and Design and the cited AMPERE Application given the concurrent existence without confusion of third-party registrations. Below is a summarized list of the registrations:
Applicant believes that it’s AMPERE TIME and Design trademark should be allowed to co-exist in the same manner as the cited registrations. The prior examples show that the term AMPERE or AMPER is commonly used in class 09 related goods. As such, Applicant’s mark should be allowed to co-exist with the existing registrations in an already crowded AMPERE marketplace. Conclusion For the reasons stated above, there is no likelihood of confusion resulting from the marks cited by the Examiner and Applicant’s mark. Applicant believes all outstanding issues with respect to the application for the subject mark have been resolved, and requests approval of the same for publication. Favorable reconsideration and allowance of the present application is hereby courteously requested. Applicant believes that it’s AMPERE TIME and Design trademark should be allowed to co-exist in the same manner as the cited registrations.
The prior examples show that the term AMPERE or AMPER is commonly used in class 09 related goods. As such, Applicant’s mark should be allowed to co-exist with the existing registrations in an already crowded AMPERE marketplace.
Conclusion
For the reasons stated above, there is no likelihood of confusion resulting from the marks cited by the Examiner and Applicant’s mark. Applicant believes all outstanding issues with respect to the application for the subject mark have been resolved, and requests approval of the same for publication.
