I am reviewing the above referenced application. In review of this application there is one issue that can be corrected without the need for an office action.

 

We require an amended identification of the goods identified in International Class 25 because the wording “apparel” and “accessories” is indefinite and must be clarified because the exact nature of the goods is not clear and it could refer to several different discrete goods and “accessories” and “bags” are too broad and can be classified in multiple classes.  Further, “bags would not be classified in Class 25. Specifically, the suggested identification would read, with suggested changes in bold:

 

International Class 13: ammunition bags

 

International Class 16: grocery bags; paper bags; gift bags

 

International Class 18: belt bags and hip bags; bags, namely, _____{specify the type of bag, e.g., barrel bags, travelling bags, weekend bags, gym bags, etc.}

 

International Class 22: mesh bags for storage; bags for securing valuables

 

 

 

International Class 26: hair accessories, namely, jaw clips, snap clips, and twisters; bird’s feathers as clothing accessories

 

International Class 28: doll accessories; boxing bags; baseball bat bags     

 

Please let me know if you would approve of my amending the identification as described.    Please note that if applicant wishes to add one or more additional classes to the application, an additional fee of $275.00 per added class will be necessary.  In that case, I will make any approved changes and issue a Priority action requiring payment of the fee(s).  Any added class will remain inactive until the fee(s) is/are paid, unless applicant specifies otherwise.   Alternatively, if you or applicant has a deposit account with the USPTO, you can provide that account number and authorize the charges against that account.
