NONFINAL OFFICE ACTION

This Office action is in response to applicant’s communication filed on May 4, 2020.
In a previous Office action dated April 24, 2020, the applicant was required to satisfy the following requirement: 1) amend the identification of goods and services.
The applicant’s response did not fully address the outstanding requirements in the Office Action dated April 24, 2020.
Further, the trademark examining attorney maintains and now makes FINAL the requirement in the summary of issues below. See 37 C.F.R. §2.63(b); TMEP §714.04.
SUMMARY OF ISSUES MADE FINAL that applicant must address:
Identification of Services-FINAL
The identification of services is still unacceptable as indefinite. The applicant must clarify the identification of services by specifying what is meant by “healthcare analytics, namely, analyzing cost effectiveness, assessing quality of healthcare, identifying healthcare insurance waste” because this description is vague and contains wording already classified in another International class. See TMEP §1402.01.

International Class 42: [ACCEPTABLE AS WRITTEN]
International Class 44: Healthcare analysis services, namely, assessing quality of healthcare

International Class 42: Software as a service (SAAS) featuring software for use in providing business consulting services in the healthcare industry, specializing in the use of analytic and statistical models to identify and prevent healthcare insurance waste, assess quality of healthcare, and assess cost effectiveness of healthcare
International Class 45: Compiling and analyzing statistical health data in order to uncover and identify health care fraud, waste and abuse and claims errors; compiling and analyzing statistical health data in order to identify and prevent healthcare insurance fraud, waste, abuse, and recoupment of inappropriate payments
Applicant may respond to this final Office action by providing one or both of the following:
