OKI SPIRITS, LLC (petitioner) petitioned the Director of the United States Patent and Trademark Office (USPTO) to issue a duplicate certificate of registration regarding the above-identified registration. The Director has authority to review this request under 37 C.F.R. §2.146(a)(3) and has delegated this matter to the Commissioner for Trademarks and the staff of the Office of the Deputy Commissioner for Trademark Examination Policy. 35 U.S.C. §3(a)-(b); 37 C.F.R. §2.146(h). The petition is granted.
FACTS
The USPTO issued the original certificate of registration for the above-identified mark on September 22, 2020. Petitioner filed a petition on March 31, 2021, to request that the USPTO issue a duplicate certificate of registration so that both members of the LLC may have a copy. Petitioner submitted a $250 petition fee and $100 new registration certificate fee with the petition.
DISCUSSION
The Director will exercise supervisory authority to grant a petition for a duplicate registration certificate if (1) the registration issued on or after September 15, 2009, (2) petitioner established good cause and (3) petitioner paid the required petition fee. See 37 C.F.R. §2.146(a)(3); Trademark Manual of Examining Procedure (TMEP) §1601.01(b).
In this case, the Director will invoke supervisory authority to instruct the Post Registration Division to issue a duplicate registration certificate. Petitioner has requested a duplicate because a certificate of registration is needed so that both members of the LLC may have a copy and has paid the required petition fee.
The USPTO will issue a partial refund of the $250 paid in excess of the $100 new registration certificate fee submitted with the petition in due course. TMEP §405.04.
DECISION
The petition is granted. The Post Registration Division will send a duplicate registration certificate in due course.
