This is further to applicant’s response of March 10, 2020, which offers an acceptable substitute specimen.

 

Application has been amended as shown below.  No prior authorization from the applicant or the applicant’s qualified practitioner is needed to issue an examiner’s amendment in this situation. TMEP §707.02.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

 

Correction to the Mark Description:  Pursuant to TMEP Section 707.02, Examining attorneys have the discretion to amend applications by examiner’s amendment without prior approval by the applicant or the applicant’s qualified practitioner (sometimes referred to as a "no-call" examiner’s amendment) in the following situations:  addition of a description of the mark where an Office action or regular examiner’s amendment is otherwise unnecessary and one of the following conditions applies:

(a) The record already contains an informal indication of what the mark comprises ( see TMEP §808.03(b));

 

The mark consists of the term “BUFF” in stylized cursive lettering.

 

The present application will proceed to publication in the Official Gazette.
